In what is widely regarded as a nod to coal state supporters and a loss for source water protection, President Trump signed legislation repealing the Stream Protection Rule on February 16.  The legislation (H.J. Res. 38) repeals the rule under the Congressional Review Act, which allows Congress to overturn federal agency rules promulgated within the past 60 legislative days. As its name implies, Stream Protection Rule offered protection through monitoring and preventing the dumping of debris from coal mining operations, particularly those using mountaintop removal techniques. Although the move was lauded by industry and political leaders in coal mining states, many consider it a significant step backwards for the protection of headland streams that feed into many drinking water sources.
