On November 2, Waterkeeper Alliance sent a notice of intent to sue (NOI) in 60 days to EPA Administrator Gina McCarthy over EPA’s alleged failure to “perform at least ten non-discretionary duties arising under the [SDWA] National Primary Drinking Water Regulation program.” Among the claims in the NOI are that EPA has missed mandatory statutory deadlines for developing regulations (or revising regulations) for several drinking water contaminants, including chromium, strontium, tetrachloroethylene, trichloroethylene, acrylamide and epichlorohydrin. The NOI also challenges EPA on missed deadlines for reviewing and taking action on contaminants as required under Contaminant Candidate List, Unregulated Contaminant Monitoring Rule, Regulatory Determination and Six-Year Review processes.
