AMWA, the Natural Resources Defense Council (NRDC), Clean Water Action (CWA), and the American Water Works Association (AWWA) wrote to EPA expressing our strong support for the use of the Negotiated Rulemaking process for the development of the next phase of the Microbial and Disinfection Byproducts (M/DBPs) Rules. EPA used the procedure when developing the initial suite of M/DBPs rules in which these organizations took part. We believe the effectiveness of the Stage 1 and Stage 2 M/DBP rules shows the benefits of employing this process. We also feel that the outcome of this collaborative undertaking was highly successful in the advancement of public health protection and negated the real potential for drawn-out litigation.
